The agreement between you and Prankwish

Plain-English Terms of Service and Conditions covering eligibility, orders, payments, content rights, prohibited use, refunds, liability, termination and contact. By using prankwish.com or placing an order, you agree to these Terms.

1 Acceptance & eligibility

By accessing prankwish.com, browsing the catalog, placing an order, or otherwise using the service, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the service.

Prankwish is intended for adults aged 18 or older. By placing an order, you confirm that you are 18+, have the legal capacity to enter a binding agreement, and that any information you provide is accurate.

2 Account & access

Prankwish supports guest checkout — no account is required to place an order. Order tracking happens through a private signed link emailed to the buyer at checkout. You are responsible for keeping that link secure; anyone with access to the link can view the order and the delivered video.

If you create or are issued any account credentials, you are responsible for activity under those credentials. Report any unauthorized use to support@prankwish.com.

3 Orders & delivery

An order is created when you complete the personalization brief and successfully pay at checkout. The brief — recipient name, occasion, pronunciation hints, inside jokes, and any add-ons — is the basis on which the assigned creator produces your video.

  • Delivery tiers: 60-minute rush, 1-day, and 2-day. The chosen tier is shown on the order detail page along with the deadline.
  • Order detail page: shows the live progress timeline (received, assigned, recording, ready, delivered) and the final video.
  • Acceptance: approving the delivery on the order detail page finalizes the order.
  • Revisions: free for legitimate brief mismatches within 7 days of delivery (see Refund Policy).

4 Payment & pricing

All prices are shown on the product or checkout page in the listed currency and include any applicable taxes unless stated otherwise. Payment is collected at checkout through a PCI-DSS-certified gateway. Card details are tokenized in your browser and are never stored on Prankwish servers.

By submitting payment information, you authorize Prankwish (via the gateway) to charge the listed amount for the order placed.

5 Content & intellectual property

The Prankwish website, the underlying platform, creator profiles, branding, written content, and the unique elements of every delivered video are protected by intellectual property rights belonging to Prankwish, the assigned creator, or both.

License to the buyer. On full payment, you receive a non-exclusive, non-transferable, royalty-free license to use the delivered video for personal sharing — sending to the recipient, posting on personal social media, family group chats, and similar non-commercial uses.

Commercial use. Reuse in advertising, branded campaigns, paid social, broadcast, resale, training of AI models, or any commercial context requires written permission from Prankwish. Contact support@prankwish.com for commercial licensing.

Your content. When you submit a brief, names, photos, or any other material, you confirm that you have the right to use it and grant Prankwish and the assigned creator a limited license to use it solely to produce and deliver the ordered video.

6 Prohibited use

The following are prohibited on Prankwish and may result in brief rejection, order cancellation, or account termination:

  • Harassment, threats, intimidation, hate speech, or discrimination targeting any individual or group.
  • Sexual content involving minors, content sexualizing real people without consent, or any content that violates child-safety laws.
  • Illegal activity, instructions for illegal acts, or content that violates applicable law.
  • Deceptive impersonation of public figures, doxxing, or content intended to defame or mislead.
  • Content infringing third-party intellectual property, trademarks, or rights of publicity.
  • Misuse of payment systems, including chargeback fraud or fraudulent disputes.
  • Automated scraping, reverse engineering, or attempts to circumvent platform security.

Prankwish reviews briefs and may refuse any request that breaches these rules. Refunds for refused briefs follow the Refund Policy.

7 Refunds, revisions & cancellations

Refund eligibility, revision handling, cancellation rules, and processing timelines are governed by the Refund Policy. In summary: full refunds apply when Prankwish cannot deliver the commissioned video — missed deadline, unavailable creator, unresolved revision within 7 days, technical defect, or cancellation before recording begins. Approved deliveries and personal-taste objections are not refundable.

Chargebacks. Always contact support@prankwish.com before filing a chargeback. Opening a chargeback while a direct refund is already in progress pauses the refund pending the bank's investigation — which is slower than the direct refund flow.

8 Availability & service changes

Prankwish may update, improve, add, suspend, or remove parts of the service as the platform evolves. Temporary interruptions can occur during maintenance, deployment, security work, or third-party provider issues. Where reasonably possible, planned maintenance is scheduled to minimize impact on active orders.

9 Disclaimers & limitation of liability

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Prankwish disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except those that cannot be excluded under applicable law.

Subject to mandatory consumer protections in your jurisdiction, Prankwish's total cumulative liability arising out of or relating to any order or use of the service is limited to the amount paid by you for the specific order giving rise to the claim. Prankwish is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or emotional distress, except where prohibited by law.

10 Indemnification

You agree to indemnify and hold harmless Prankwish, its creators, employees, and partners from any claims, damages, or costs arising out of: (a) content or material you submit that breaches these Terms or applicable law, (b) your misuse of the delivered video beyond the personal-sharing license, or (c) your breach of these Terms.

11 Suspension & termination

Prankwish may suspend or terminate access for any user who breaches these Terms, attempts fraudulent payment activity, abuses the support process, or engages in prohibited use. Where lawful, Prankwish will provide notice and the opportunity to resolve the issue. Termination does not affect rights and obligations that arose before termination.

12 Governing law & dispute resolution

These Terms are governed by the laws under which Prankwish operates, without regard to conflict-of-law principles. Subject to any mandatory consumer protections in your country of residence, disputes arising out of or relating to these Terms or the service shall first be raised in writing to support@prankwish.com for good-faith resolution before any formal proceedings.

13 Changes to these Terms

These Terms may be updated to reflect new services, payment rails, legal requirements, or operational improvements. The version live at prankwish.com/terms is always the active agreement. Material changes affecting active customers will be announced by email where applicable.
